Placing an order for any product listed in the online store at cristalartdeco.com requires the customer to review and accept these Terms and Conditions of Sale beforehand. Clicking the button to confirm an order constitutes full acceptance of these Terms and Conditions. This action has the same effect as an electronic signature.

Object :

These terms and conditions are intended to define the rights and obligations of the parties in connection with the online sale of goods offered by Cristal Art & Deco to consumers.

Payment :
Cristal Art & Déco accepts the following payment methods:
– Credit and debit cards: Visa, Mastercard, Carte Bleue, American Express, Maestro.
– PayPal.
– Bank transfers (mandatory for purchases exceeding $6,000 including VAT when payments originate from abroad).

Order confirmation :

The contractual information will be confirmed by email to the address provided by the customer on the order form.

Proof of transaction :

Computerized records stored in Cristal Art & Déco’s computer systems under reasonable security conditions shall be considered evidence of communications, orders, and payments made between the parties.

Order forms and invoices are archived on a reliable and durable medium and may be produced as evidence.

Products information :

Every effort has been made to ensure the accuracy of the information presented on cristalartdeco.com. However, Cristal Art & Déco and its suppliers shall not be held liable for any consequences, incidents, or special damages resulting from improper or non-recommended use of the products (for example, cuts caused by the accidental or intentional breakage of crystal or glass objects).
Product and manufacturer names and trademarks are used solely for identification purposes. Product photographs, descriptions, and prices are provided for informational purposes only and are not contractually binding.

ITEM AVAILABILITY

The availability of each item is checked and confirmed in the order summary submitted to the customer for approval before the order is finalized.

Despite the care taken by Cristal Art & Déco in managing its inventory and the information displayed on the Website, an item may become unavailable after the customer has placed an order and Cristal Art & Déco has confirmed it, due to the simultaneous processing of multiple orders, an error, or damage to an item in stock.

In such cases, Cristal Art & Déco will send the customer an email offering the following options:

Either wait until the item becomes available again,

Or cancel the order and purchase another in-stock item listed on the Website,

– Or cancel the order and receive a refund.

Orders for Products Marked as “Out of Stock”

Cristal Art & Déco will keep the customer informed of the order’s progress if an item is marked as “Out of Stock,” “Available on Order,” “Subject to Availability,” or any other designation indicating that the item is not immediately available.

If an item is marked as “Available on Order” or “Out of Stock,” and the customer has been informed of and accepted the estimated waiting period, the order cannot be canceled or refunded, as Cristal Art & Déco has committed to having the products manufactured by its suppliers and manufacturers.

Delivery terms :

Products are delivered to the address provided by the customer on the order form.

All products leave our premises in perfect condition. The customer must report any signs of damage to the package, however minor (holes, crushing marks, etc.), to the carrier (or postal delivery person) and, if necessary, refuse delivery of the package. An identical replacement product will then be shipped free of charge.

Any product subsequently reported as damaged during shipping, without any damage having been noted or reported upon receipt of the package, will not be eligible for replacement.

As with any shipment, delays may occur or a package may be lost in transit. In such cases, we will contact the carrier to initiate an investigation. Every effort will be made, for as long as necessary, to locate the missing package. If the package cannot be recovered, Cristal Art & Déco will seek reimbursement from the carrier and ship an identical replacement package at its own expense.

We disclaim all liability for extended delivery times caused by the carrier, particularly in cases of lost products, adverse weather conditions, or strikes.

Delivery issues caused by the carrier :

Any irregularity concerning the delivery (damage, missing products compared to the delivery note, damaged packaging, broken products…) must be clearly noted on the delivery note and accompanied by the customer’s signature.

The customer must also confirm the issue by sending the carrier a registered letter with acknowledgment of receipt, detailing the complaint, within two (2) business days following the delivery date.

The customer must send a copy of this letter to Cristal Art & Déco, 229 rue Saint-Honoré, 75001 Paris, France. Without this written damage report, no replacement will be provided.

Delivery errors :

The customer must report any delivery error and/or any discrepancy in the type or quality of the products compared to the details stated on the order form to Cristal Art & Déco on the day of delivery or, at the latest, within seven (7) business days following delivery.
Any claim submitted after this period will be rejected.

Claims may be submitted to Cristal Art & Déco by sending a signed letter to the following address : 229 rue Saint-Honoré, 75001 Paris, France.

Any claim that does not comply with the procedures and deadlines specified above will not be considered and will release Cristal Art & Déco from any liability toward the customer.

In the event of a delivery error or product exchange, any product to be exchanged or refunded must be returned in its entirety, in its original packaging and in impeccable condition, to the following address : 229 rue Saint-Honoré, 75001 Paris, France.

To be accepted, all returns must be reported to and approved in advance by Cristal Art & Déco. Once approved, Cristal Art & Déco will arrange for the package to be shipped to the correct address.

Shipping costs will be covered by Cristal Art & Déco, unless the returned product does not match the original description provided by the customer in the return request.

Products guarantee :

Product Guarantee :Nothing in these Terms and Conditions shall deprive the consumer of their statutory warranty rights, which require the professional seller to protect the consumer against all consequences arising from hidden defects in the goods sold.

The customer is expressly informed that Cristal Art & Déco is not the manufacturer of the products offered on cristalartdeco.com and that Cristal Art & Déco disclaims all liability for defective products.

Consequently, in the event of personal injury or property damage caused by a defective product, the consumer may seek to hold only the product’s manufacturer liable.

Right of withdrawal:

The right of withdrawal applies only to natural persons (individual consumers).

In accordance with Article L. 120-20 of the French Consumer Code, the consumer has fourteen (14) calendar days to return, at their own expense, any products they are not satisfied with. This period begins on the date the consumer receives their order. Any return may be reported in advance to Cristal Art & Déco. Products must be returned to the following address : 229 rue Saint-Honoré, 75001 Paris, France.

Only products returned in their entirety, in their complete and undamaged original packaging, and in perfect resale condition will be accepted. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded, accepted for return, or exchanged. The right of withdrawal may be exercised without penalty, except for shipping and return costs. When exercising this right, the consumer may choose either a refund of the amounts paid or a product exchange. In the event of an exchange, the customer will be responsible for the cost of shipping the replacement product.

If the consumer exercises their right of withdrawal, Cristal Art & Déco will make every effort to issue a refund within thirty (30) days.

Usage rights :

Any use of the trademarks displayed on the Website is strictly prohibited.

Force majeure :

Neither party shall be considered in breach of its contractual obligations if the performance of those obligations is delayed, hindered, or prevented by an unforeseen event or a force majeure event. A force majeure event shall be defined as any circumstance that is beyond the control of the parties, unforeseeable, unavoidable, and impossible to overcome despite all reasonable efforts.

The party affected by such circumstances must notify the other party within ten (10) business days of becoming aware of the event.

The two parties shall then meet within three (3) months, unless prevented from doing so by the force majeure event, to assess its impact and agree on the conditions under which the contract may continue to be performed.

In addition to events traditionally recognized as force majeure under French case law, the following shall expressly be considered force majeure events or unforeseen circumstances : transportation disruptions or blockages, earthquakes, fires, storms, floods, lightning strikes, telecommunications network outages, and difficulties affecting third-party telecommunications networks.

Governing law :

These terms and conditions are governed by French law, both in matters of substance and procedure.

In the event of a dispute or complaint, the customer shall first contact Cristal Art & Déco to seek an amicable resolution.

Personal data protection :

All personal data you provide to us is collected and used for the purpose of processing your orders.
In accordance with French Law No. 78-17 of January 6, 1978, relating to information technology, data files, and civil liberties, you have the right to access, rectify, modify, and delete the personal data you have provided to us. These rights may be exercised by contacting the Seller or online.

Disputes :

Any order placed through cristalartdeco.com constitutes the customer’s full and unconditional acceptance of Cristal Art & Déco’s terms and donditions.

In the event of a sale to a legal entity, any dispute relating to the sale (prices, TCS, products, etc.) shall be governed by French law and submitted to the Commercial Court having jurisdiction over Cristal Art & Déco’s registered office.
